Wimsy.net Terms and Conditions of Use

1. Acceptance of Terms

By accessing and using the Wimsy.net website (the “Service”), you agree to be bound by these Terms and Conditions (“Terms”), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you are prohibited from using or accessing this Service. Wimsy.net is owned and operated by Crossroads Media.

2. User Eligibility and Parental Consent

The Service is intended for use by adults (parents and legal guardians) for the benefit of children.

• Adult Users: You must be at least 18 years old to create an account, purchase a subscription, or submit any personalization details.
• COPPA Compliance: If you are the parent or legal guardian of a child under the age of 13, you represent and warrant that you have provided verifiable consent for your child’s first name and favorite things to be used solely for the purpose of generating personalized stories, as described in our Privacy Policy. You are responsible for supervising your child’s use of the Service.

3. Account Creation and Responsibilities

• Account Information: You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
• Security: You must notify Wimsy immediately upon becoming aware of any breach of security or unauthorized use of your account.
• Story Content Input: You agree that any information you input for story personalization (names, preferences, etc.) is not confidential and will be used to generate unique story content. You agree not to input any illegal, abusive, harmful, or personally identifying information (other than a first name/nickname) into the story prompts.

4. Subscription and Payments

• Billing: Services are billed on a subscription basis (e.g., monthly or annually). You agree to pay all charges incurred under your account at the rates in effect when the charges are incurred.
• Automatic Renewal: Unless you cancel your subscription, it will automatically renew at the end of each billing cycle, and you authorize us to charge your payment method for the renewal term.
• Refunds: Subscription fees are generally non-refundable. Any exceptions will be at the sole discretion of Wimsy.

5. Intellectual Property and Content Use

• Service Content: All content, features, and functionality of the Service, including text, graphics, logos, and software, are the exclusive property of Wimsy.net and are protected by international copyright laws.
• Your Stories: The unique stories generated for you through the Service are provided to you for personal, non-commercial use only. You are granted a limited, non-exclusive, non-transferable license to read and share the stories within your immediate family. You may not republish, distribute, sell, or commercially exploit the generated stories without prior written consent from Wimsy.net.
• Feedback: If you provide Wimsy with any feedback, ideas, or suggestions (“Feedback”), you grant Wimsy a perpetual, worldwide, transferable license to use this Feedback without any compensation to you.

6. Limitations of Liability

Wimsy.net and its owners will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Insert Your State/Country], without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
